Compliance

The Retirement Corporation of America® ("RCA") is subject to regulation by the United States Securities and Exchange Commission (“SEC”) and state securities regulators.  RCA is required to comply with the Investment Advisers Act of 1940, as amended (the “Advisers Act”), as well as all other applicable federal and state securities laws, and rules and regulations issued by the SEC.  RCA maintains and enforces written policies reasonably designed to comply with the Advisers Act and other applicable state and federal securities laws as required by Rule 206(4)-7 under the Advisers Act.  Rule 206(4)-7 under the Investment Advisers Act of 1940, as amended, is designed to protect investors by requiring advisers to have internal programs to enhance compliance with the federal securities laws.  Specifically, Rule 206(4)-7 requires SEC registered investment advisers to:



(i) adopt compliance policies and procedures designed to prevent violations of applicable securities laws, including the Advisers Act;
(ii) review its established policies and procedures for their adequacy and the effectiveness of their implementation at least annually; and

(iii) designate a chief compliance officer to be responsible for administering the policies and procedures.


In addition to complying with applicable laws and regulations, all credentialed professionals are also required to comply with a code of ethics set up and enforced by industry groups for Chartered Financial Analysts (CFA) charterholders, Certified Financial Planners (CFP) and Certified Public Accountants (CPA), as well as the RCA Code of Ethics.


RCA also maintains a policy concerning employee's personal securities transactions as part of RCA's Code of Ethics. RCA establishes the standard of business conduct for all employees that is based upon the fundamental principles of openness, integrity, honesty and trust.

At RCA, we have a Chief Compliance Officer who is responsible for overseeing all internal and external compliance issues. Our Chief Compliance Officer also works closely with outside legal counsel to help ensure that RCA is meeting or exceeding these standards.
